Terms of Service

1. Scope of application

These terms and conditions apply to all guest accommodation contracts concluded between the Hotel Garni Engelberg as well as to all other services and deliveries provided. The Hotel Garni Engelberg is legally represented by Roman Jöchle, hereinafter referred to as the “operator”

2. Reservations / Resale

By accepting a reservation made by the guest, an accommodation contract is concluded. This agreement, in the form of a reservation of reserved rooms, is binding for both contracting parties. Reservations for rooms that have been ordered but not yet paid for are valid until 6 p.m. on the day of arrival. There is no entitlement to use the overnight service in a specific room. The operator reserves the right to rent the reserved rooms to someone else after the reservation has expired. The guest receives a binding booking or reservation number from the operator and, if expressly requested, a written confirmation of reservation. Reselling / letting and / or brokerage of booked rooms is prohibited. In particular, the brokerage of rooms and / or room allotments to third parties at prices higher than the actual room prices is not permitted. The assignment or sale of the claim against the operator is also not permitted. In these cases, the operators are entitled to cancel the booking, in particular if the guest has provided false information to the third party about the type of booking or payment during the assignment / sale. Use of the hotel room for any purpose other than accommodation is expressly prohibited.

3. Guaranteed reservations, cancellation deadlines

A guaranteed reservation exists if the guest confirms the overnight service by means of a credit card number and does not cancel the booked room before 6 p.m. on the day of arrival. If the guest does not appear (no show), the full amount of the booked stay will be charged, minus any saved expenses. For bookings under an allotment contract or for a reservation of more than five rooms per night, the cancellation deadlines and other agreements agreed in these contracts apply.

4. Advance payment of the overnight price

The price of the entire booked accommodation service must always be paid in advance by the guest, at the latest upon arrival at the hotel.

5. Taxes / Fees / Charges

The applicable prices are gross total prices and include all statutory taxes, fees and charges. In the event of a change in tax, fee and duty rates as well as the effective collection of new taxes, fees and charges unknown to the parties, the operator reserves the right to adjust the prices accordingly.

6. Means of payment / services on invoices to be paid later

Valid means of payment are cash in euros, EC card, Master Card, Visa Card, Diners Card and American Express in euros. It is not possible to provide services on invoices to be paid later.

7. Possibilities of using reserved rooms

Reserved rooms are available to the guest from 3 p.m. on the day of arrival and until 12 p.m. on the day of departure.

8. Liability of the operator

The operators are liable for damage caused by injury to life, limb or health for which they are responsible. Furthermore, the operators are liable for other damage that is based on an intentional or grossly negligent breach of duty by the operator as well as for damage that is based on an intentional or negligent breach of typical contractual obligations. A breach of duty by the operator is equivalent to that of his legal representatives, employees or vicarious agents. Further claims for damages are excluded, unless otherwise regulated in these terms and conditions. Should disruptions or deficiencies in the services of the operators occur, the operators will endeavor to remedy the situation upon knowledge or upon immediate complaint by the guests. The guest is obliged to do what is reasonable for him to remedy the disruption and to keep possible damage to a minimum. In addition, the guest is obliged to inform the operator in good time of the possibility of exceptionally high damage. The operator is liable for items brought in according to the statutory provisions (cf. §§ 701 ff. BGB). The liability is limited to a hundred times the room rate (from EUR 600 to a maximum of EUR 3,500) and for money, securities and valuables up to EUR 800. The claim expires if the guest does not notify the operator immediately after becoming aware of the loss, destruction or damage of the item brought in (§ 7

9. Vouchers

The voucher can only be redeemed for the hotel’s own services in the hotel noted on the voucher. If there is a remaining credit left after paying with the voucher, it will remain and can be used for further payments in the respective hotel. The voucher is valid for 3 years from the date of issue. Vouchers cannot be returned, they are not resalable or transferable and cannot be redeemed for cash. The vouchers cannot be used for online payments. The person ordering the voucher is responsible for providing the correct data (in particular the email address) to which the voucher and the invoice are to be sent.

9.1. Cancellation policy:

Changes to vouchers can be revoked within 14 days without giving reasons in any form (letter, fax, email) or, if the voucher is provided before the deadline, by returning the voucher. The period begins after receipt of this instruction in writing, but not before the recipient has received the voucher. The timely dispatch of the revocation or the goods is sufficient to meet the revocation period. The revocation must be sent to the operator as listed in the imprint

10. Food and drinks brought along

Breakfast can only be taken in the designated rooms in the public area (bar, lounge). It is not possible to take away any of the breakfast items offered. The preparation of food is prohibited in the rooms.
The Hotel Engelberg is a non-smoking hotel. It is therefore forbidden to smoke in the public areas as well as in the guest rooms. In the event of an infringement, the operator has the right to demand an amount of EUR 50.00 from the guest as compensation for the separately incurred cleaning costs, including any loss of revenue from renting the room that is not possible as a result. This amount of compensation is to be set higher or lower if the Hotel Engelberg proves greater damage or the guest proves less damage.

11. Pets

Bringing a pet requires the approval of Hotel Engelberg. He is obliged to announce the wish to bring a pet in advance. If the Hotel Engelberg agrees to bring the pet, this happens on the condition that the pet is under the constant supervision of the guest, is free from diseases and does not pose any other danger to the hotel guests and the hotel staff. It is not permitted to take the animal with you at breakfast or at the bar at Hotel Engelberg. There is a fee of EUR 10.00 per night for the pet. Exceptions are, however, blind, deaf and other comparable service dogs. These can be carried free of charge and at any time.

12. Group bookings

For bookings of eleven rooms or more, guaranteed reservations can only be made with appropriate advance payment. In addition, the separate contractual provisions of the respective hotels apply here.

13. Final provisions

Changes and additions to the contract or the general terms and conditions should be made in text form. Unilateral changes or additions by the guest are ineffective. The place of jurisdiction for all disputes between the parties arising from the contractual relationship, insofar as the contractual partner is the operator, legal entity under public law or special fund under public law, is Germany.
