1. Scope of application
These terms and conditions apply to all guest accommodation contracts concluded between the Hotel Garni Engelberg as well as to all other services and deliveries provided. The Hotel Garni Engelberg is legally represented by Roman Jöchle, hereinafter referred to as the “operator”
2. Reservations / Resale
By accepting a reservation made by the guest, an accommodation contract is concluded. This agreement, in the form of a reservation of reserved rooms, is binding for both contracting parties. Reservations for rooms that have been ordered but not yet paid for are valid until 6 p.m. on the day of arrival. There is no entitlement to use the overnight service in a specific room. The operator reserves the right to rent the reserved rooms to someone else after the reservation has expired. The guest receives a binding booking or reservation number from the operator and, if expressly requested, a written confirmation of reservation. Reselling / letting and / or brokerage of booked rooms is prohibited. In particular, the brokerage of rooms and / or room allotments to third parties at prices higher than the actual room prices is not permitted. The assignment or sale of the claim against the operator is also not permitted. In these cases, the operators are entitled to cancel the booking, in particular if the guest has provided false information to the third party about the type of booking or payment during the assignment / sale. Use of the hotel room for any purpose other than accommodation is expressly prohibited.
3. Guaranteed reservations, cancellation deadlines
A guaranteed reservation exists if the guest confirms the overnight service by means of a credit card number and does not cancel the booked room before 6 p.m. on the day of arrival. If the guest does not appear (no show), the full amount of the booked stay will be charged, minus any saved expenses. For bookings under an allotment contract or for a reservation of more than five rooms per night, the cancellation deadlines and other agreements agreed in these contracts apply.
4. Advance payment of the overnight price
The price of the entire booked accommodation service must always be paid in advance by the guest, at the latest upon arrival at the hotel.
5. Taxes / Fees / Charges
The applicable prices are gross total prices and include all statutory taxes, fees and charges. In the event of a change in tax, fee and duty rates as well as the effective collection of new taxes, fees and charges unknown to the parties, the operator reserves the right to adjust the prices accordingly.
6. Means of payment / services on invoices to be paid later
Valid means of payment are cash in euros, EC card, Master Card, Visa Card, Diners Card and American Express in euros. It is not possible to provide services on invoices to be paid later.
7. Possibilities of using reserved rooms
Reserved rooms are available to the guest from 3 p.m. on the day of arrival and until 12 p.m. on the day of departure.
8. Liability of the operator
The operators are liable for damage caused by injury to life, limb or health for which they are responsible. Furthermore, the operators are liable for other damage that is based on an intentional or grossly negligent breach of duty by the operator as well as for damage that is based on an intentional or negligent breach of typical contractual obligations. A breach of duty by the operator is equivalent to that of his legal representatives, employees or vicarious agents. Further claims for damages are excluded, unless otherwise regulated in these terms and conditions. Should disruptions or deficiencies in the services of the operators occur, the operators will endeavor to remedy the situation upon knowledge or upon immediate complaint by the guests. The guest is obliged to do what is reasonable for him to remedy the disruption and to keep possible damage to a minimum. In addition, the guest is obliged to inform the operator in good time of the possibility of exceptionally high damage. The operator is liable for items brought in according to the statutory provisions (cf. §§ 701 ff. BGB). The liability is limited to a hundred times the room rate (from EUR 600 to a maximum of EUR 3,500) and for money, securities and valuables up to EUR 800.
